These terms govern quotations, supply, installation and service work carried out by DynaLogic Select Sp. z o.o. They are written for business customers; where a customer is a consumer, mandatory consumer law prevails over anything below that conflicts with it.
1. Supplier
DynaLogic Select Sp. z o.o., ul. Bułgarska 14, Hall B, 60-320 Poznań, Poland. KRS 0000418822, VAT PL7811894420. [email protected], +48 61 222 4180.
2. Quotations
Written quotations are valid for 60 days and are based on the conditions recorded in our site survey. We do not raise variations for anything the survey should reasonably have identified. We will raise a variation where the site condition changes after the survey, where the customer alters the specification, or where access, power or floor condition differs from what was represented to us.
3. Orders and cancellation
An order is accepted when we issue an order confirmation. Standard stocked goods may be cancelled without charge up to 48 hours before despatch. Bespoke or made-to-order goods — cut-to-length steel, mezzanine structures, engineered conveyor — cannot be cancelled once fabrication has started; we will always tell you the point of no return in writing.
4. Prices, payment and title
Prices are in euro or Polish złoty as stated, exclusive of VAT, which is applied at the rate in force. Standard terms are 30 days net for approved accounts and pro forma otherwise. Statutory interest applies to late payment under Polish law. Title to goods passes on full payment; risk passes on delivery to the site.
5. Delivery and lead times
Consumables and standard handling equipment despatch within 24 hours of order. Standard racking components run 5–10 working days, and bespoke structures 4–7 weeks. Lead times are confirmed in writing at order stage. The customer is responsible for providing safe access, unloading points, and a hard standing suitable for the delivery vehicle.
6. Installation
Installation is carried out by our own crews or by named subcontractors under our supervision. Before work begins the customer must provide: a nominated safety contact, agreed exclusion zones and traffic routes, unobstructed working areas, and confirmation of the floor slab specification. Delays caused by unavailable access are chargeable at the day rate stated in the quotation.
7. Structural responsibility
Load calculations are prepared on the basis of the pallet weights, dimensions and handling equipment the customer declares to us. Changing pallet weights, beam levels or truck type after handover invalidates those calculations. Racking must not be modified, drilled, welded or extended with components from another manufacturer; doing so voids all warranties and, in our experience, is the most common precursor to a collapse.
8. Warranty
- Racking structures: 12 months on installation workmanship, plus the manufacturer's structural warranty, typically 10 years.
- New handling equipment: 24 months or 2 000 operating hours, whichever comes first.
- Refurbished handling equipment: 12 months, with a five-year parts availability commitment.
- Excluded: impact damage, corrosion from misuse, consumable and wear parts, and any equipment modified without written approval.
9. Inspection obligations
EN 15635 requires the operator to appoint a person responsible for storage equipment safety, to record damage, and to have racking inspected by a competent person at least annually. Supplying and installing the equipment does not transfer that duty to us. We offer inspections as a service and will remind you when one is due, but the legal obligation remains with the operator.
10. Liability
We are liable for damage caused intentionally or by gross negligence, for personal injury, and for anything else that cannot be excluded by law. Otherwise our aggregate liability under a contract is limited to the value of that contract, and we exclude liability for loss of profit, loss of production and other indirect loss. Nothing here limits liability arising from a structural defect in equipment we supplied and installed.
11. Force majeure
Neither party is liable for delay caused by events beyond reasonable control, including steel supply interruption, industrial action, extreme weather and restrictions imposed by authorities. We will notify you promptly and agree a revised date rather than leaving a project open-ended.
12. Law and jurisdiction
Polish law applies. The courts of Poznań have jurisdiction for business customers, without prejudice to mandatory consumer rules where a consumer is involved.
